Rescue Efforts Continue Following Horrific Fertilizer Plant Explosion In West, Texas
April 18. 2013 13:29 by

By now, most people have likely seen the terrifying video footage that captured the fertilizer plant explosion in West, Texas. This fertilizer plant explosion only adds to what has been a difficult and tragic week.   But as is expected, the good people of this great state are responding to do their part to assist those in need as evidenced by blood drives popping up in communities throughout the state. I have no doubt these charitable efforts and more will continue as long as the citizens in West need our assistance. Like many who routinely drive I-35 between Dallas and Austin, a pit stop in West is a cherished tradition for many in our firm. Our sincerest thoughts and prayers go out to the West community and all the family members affected by this tragedy.

Jurors Left in Tears After Paralyzed Girl Victimized by Drunk Driver Reads Letter
December 10. 2012 13:49 by

In the summer of 2011, then 7-year-old Xitclalli "Chilli" Vasquez was left paralyzed from the chest down in an accident involving a drunk driver. In July, Chilli and her sister were riding in a car with their aunt to a mall to get their nails and hair done, according to news reports. It was during this trip that the aunt's car was struck by a car driven by Jeremy Solis, who was found to be intoxicated. The vehicle driven by Solis had been stolen in Fort Worth. He was found to have a blood alcohol level of 0.23, nearly three times the legal limit.

Recently, Solis was in court for sentencing. It was during this court hearing that jurors heard what Chilli had written in a letter to Solis about her experiences since she had become paralyzed. The jury, those present in the courtroom and even Solis were left in tears after Chilli's mother read the 4-page letter, which talked about her experiences in the hospital, how she would cry because she couldn't do things she used to do, how she had to use her thumb to answer questions because she could not talk. One question Chilli had written in the letter was, "Look at what I said and the words I said and tell me how I look and feel. How do you feel today? Do you remember July 9th?"

Solis was charged with intoxication assault (two counts) and pleaded guilty to the charges. He was sentenced to 10 years in prison, and according to news reports will be eligible for parole in 5 years. Prosecutor Allenna Bangs stated that there were no restitution charges, and that Solis is 21 years old and has no criminal history.

Chilli told ABC News that she plans to send more letters to Solis while he is serving his sentence, and that she hopes he will respond to the letter that was read in court. She said she hopes he will apologize, that it will "make me happy if he says he is sorry."

Even for Dallas personal injury lawyers who see tragedy every day, this is an extremely sad and unfortunate story. The victim in this case, who is now 9 years old, is strong-willed and determined to walk again one day. Hopefully Solis will have time to think about his actions while serving his sentence, and won't repeat the same mistake.

Grapevine Woman Under the Influence Crashes with North Richland Hills Police Officers
December 10. 2012 13:47 by

Recently, 27-year-old Judith Dee Hodges was arrested after an accident that left two North Richland Hills officers with minor injuries. Hodges was charged with possession of dangerous drugs and driving while intoxicated.

According to news reports, the crash took place near the Hurst city limits, in the northbound lanes of the 1200 block of Northeast Loop 820. Hodges was allegedly driving north on the loop when her vehicle crashed into the back of one officer's patrol car, then clipped another patrol car according to Keith Bauman, a North Richland Hills investigator.

The two police officers involved in the crash were Officer Oscar Saenz and Sgt. Todd Hanson; they were treated and released at local area hospitals with only minor injuries. Investigator Bauman said that Saenz and Hanson were in marked police vehicles when the accident occurred. Hurst, Richland Hills and North Richland Hills and Watauga emergency crews assisted at the scene of the accident.

Hodges was arrested at the scene, but information regarding the type of drugs seized after the accident was not released at the time of news reports. Hodges was transported to the North Richland Hills Detention Center in lieu of $2,000 bail.

While Hodges will likely face substantial penalties if convicted for DWI and drug possession, the circumstances could have been far worse. If the police officers involved had suffered serious injuries or even lost their lives, Hodges may have been the defendant in a personal injury or wrongful death lawsuit. When individuals are seriously injured because of a negligent, intoxicated or otherwise careless motorists, they are entitled to compensation of costs associated with their injuries which may include not only medical costs, but lost wages, pain and suffering, and more.

Southeast Dallas DWI Crash Ends in Two Deaths

On Monday night just two nights before Halloween, a four-car crash in southeast Dallas ended in tragedy. A man who was said to be driving under the influence caused the deadly crash that took two lives, one of the victims unidentified, the other 43-year-old Lashun Russel. Russel's daughter was ejected from the vehicle and rushed to Children's Medical Center.

According to police and news reports, a man in a black Ford pickup was traveling in a westbound direction on Military Parkway when he ran a red light and plowed into a Honda, causing the Honda to spin before crashing into a Chevy Trailblazer and a Taurus. The victims who lost their lives were both occupants of the Taurus, which was ultimately slammed into a utility pole after the accident.

The driver of the Ford pickup allegedly attempted to flee the scene on foot after causing the accident; however witnesses said that as he tried to run, a Good Samaritan caught the suspect and restrained him until police arrived.

The man who caused the accident, 34-year-old Leodegario Hernandez Juarez, was found to be under the influence of alcohol. He was charged with two counts of intoxication manslaughter and one count of intoxication.

This story is tragic, and should open up our eyes to the dangers of driving after consuming alcohol. While Juarez will likely be placed behind bars for a very long time, families have lost their loved ones. As Dallas personal injury attorneys, we know that although Juarez will spend time in prison, surviving family members may wish to file a wrongful death lawsuit. While no amount of money can ever replace the loss of a loved one, it can help with lost income, funeral and burial costs and other financial burdens.

If you have suffered injuries as the result of someone else’s negligence, or lost a child, spouse, parent or other loved one because of misconduct or carelessness, do not hesitate to contact an experienced Dallas personal injury lawyer. Those who are negligent should be held accountable; securing fair compensation will help you begin the process of healing so that you can put your life back on track.

Fiery Dallas Crash Leaves 2 Dead, 2 Injured
October 9. 2012 17:47 by

On Friday October 5th, an early morning crash occurred between Lemmon Avenue and Hall Street along the northbound access road of U.S. Highway 75 Central Expressway, leaving two people dead and two injured.

Dallas police say one vehicle was involved in the crash which occurred when that vehicle ran off of the road, plowed through an iron fence, then struck a utility pole. At that point, the vehicle burst into flames.

News reports state that authorities were on the scene when firefighters arrived, and that the vehicle was completely engulfed in flames. Paramedics found two dead bodies inside the vehicle after the fire was extinguished. The victims' bodies were burned severely, making immediate identification impossible according to a representative from the Dallas County Medical Examiner's office. As of Friday morning, one victim was listed in serious condition, the other in critical condition.

An update to this story published just hours after the original story stated that it had been determined that speeding caused the crash. Those who lost their lives were identified as 25-year-old Joshua Armstead, the driver of the vehicle, and a passenger, 19-year-old Fred Pupenbroke III. The car that crashed and caught fire was a 2001 Dodge Stratus.

An apartment complex sets immediately beside the scene of the crash; a neighbor told police that some residents of the apartment building helped pull two occupants of the burning vehicle out of the car prior to it burning out of control. Police said those individuals were rushed to area hospitals.

As experienced Dallas car accident attorneys, we know tragic accidents happen all too often, taking the lives of young people who had bright futures ahead of them. Speeding is extremely common, particularly among teens and young adults - however thankfully, it doesn't always end like this story did.

The two individuals who sustained injuries in this crash will likely be facing substantial medical costs due to their injuries. If you or a loved one have been injured in a car accident due to the negligence of another party, consult with a skilled Dallas personal injury lawyer at once to determine if you have a claim, and if legal action should be taken to obtain the full compensation you deserve.

Texas Trucking Accident Kills Three People
July 31. 2012 12:58 by

A wrong way driver on Interstate 35 set off a deadly chain reaction early Monday morning. The events leading up to the deadly trucking accident began at around 3 a.m. Monday morning when a small sedan was spotted driving south in the Northbound lanes of I-35 in Schertz, Texas near San Antonio. The wrong way driver caused an initial car accident that resulted in only minor injuries. A tanker truck driver, however, failed to see the initial crash and drove through the car accident scene striking and killing two good samaritans that stopped to render aid in response to the first car accident. The other victim was the wrong way driver that caused the initial car accident. Five other individuals were taken to area hospitals for minor injuries. There is no word at this time if alcohol played a role in this horrific accident.

Horrific accidents such as this one come with complicated legal questions, such as who is legally responsible for the deaths and injuries to these innocent victims? Does all responsibility fall on the wrong way driver? Is the truck driver responsible for not keeping a proper lookout? These questions require experienced personal injury attorneys with the tools to investigate serious accidents such as this one. The Austin and Dallas personal injury attorneys at Wilson Trosclair & Lovins have that experience. Call us today at 214-484-1930 if you were injured due to the negligence of another person
