An Austin car accident involving a pedestrian left one person dead early this morning, Austin police officers are reporting. Police officers say that a 911 call was received from the driver an SUV at approximately 6:45 reporting that he struck pedestrian that “stepped out into their lane.” The pedestrian accident happened at East Dessau Lane and Braker road. It was originally thought that an 18-wheeler was involved in, the accident, but police have determined that the SUV was the only car involved. Police are unsure why the pedestrian walked into traffic. The undisclosed pedestrian was pronounced dead at the scene of the accident.

Ernest and Barbara Boyett of Austin were killed in a car wreck last night at approximately 9:15 p.m. while traveling east on Highway 290 near Baxter Lane in the Southwest part of Travis County. The fatal car accident occurred when Terri Elmore, driving in the opposite direction as the Boyett’s crossed the center line of traffic casuing a head on collision. Both Earnest and Barbara Boyett were pronounced dead at the scene. Terri Elmore remains in critical condition UMC Breckenridge. Officers are unsure what caused Ms. Elmore to cross the center line and enter the Boyetts lane of traffic. Considering the fatalities involved and the severity of the injuries Ms. Elmore sustained, it is likely that the exact cause of this car accident will ever be known.

Austin police officers have finally identified 19 year old Ellis McClane as the passenger that died in the Friday early morning car accident in Northwest Austin. Mr. McClane was the passenger in a car crash that occurred on Lakeline Boulevard near West Parmer Lane. The driver of the car lost control and the vehicle rolled over before wrecking into a tree. The impact was so load that numerous nearby residents called 911 after hearing the car wreck. The driver and the two passengers were all unconscious when EMS arrived. The driver and one passenger remain in critical condition in Round Rock.   Mr. McClane died at the scene of the accident. Officers are unsure as to the exact cause of this Austin car accident, but they believe speed played a role. They are trying to determine if alcohol was also involved.

Police officers have issued an arrest warrant for Jose Genaro Bernal, charging him with failure to stop and render aid, which is a third degree felony. The charges stems from an Austin hit and run accident resulting in the death of University of Texas at Austin student Adam Grote. The hit and run pedestrian accident occurred this past Sunday at 3 a.m. as Mr. Grote was walking on the southbound shoulder of I-35 in Austin near Riverside Drive. Mr. Bernal’s car struck Mr. Grote, who was pronounced dead at the scene, and Mr. Bernal drove off without rendering aid. Fortunately, a witness to the crash provided a license plate number to investigators, which matched Mr. Bernal’s license plate. Mr. Bernal did stop some 17 miles after the hit and run pedestrian accident where he told an Austin police officer he was involved in an a car accident. Of course, that was 17 miles too late.

An eight day trail ended with a verdict awarding $8.2 million the family of a young child that sustained severe brain injuries in an Austin car accident involving a Capital Metro bus and a day care facility’s suburban. The car accident happened in 2008 at the intersection of Far West and Hart Lane. The jury placed 35% liability on the Capital Metro bus driver for driving 38 mph in a 30 mph zone and entering the intersection on a yellow light and 65% on the day care employee for running a red light. The day care previously entered into a confidential settlement prior to the trial. The question now is whether Metro Capital is on the hook for the judgment against its driver, which totals approximately $3 million? Because of statutory capes limiting liability against Metro Capital to $100,000, Capital Metro was left out of the suit and only the driver was named. Capital Metro’s insurer, however, may still be liable for the jury award.

While this $8 million verdict is substantial, estimates of future care for the injured child reach as high as $20 million. The child had numerous surgeries following the accident and has permanent disabilities, such as loss of senses and antisocial behavior. One of the qyestions a case like this raises is whether caps on damages are fair and just? Why should Metro Capital not have to be fully accountable for the injuries a jury held its employee caused? Is it fair that a family, through no actions of their own, are now forced to deal with economic ruin because a law states that Metro Capital, no matter how egregious their actions, cannot be held liable for more than $100,000? It is hard to see the fairness in that.

Four 18-wheelers and one pickup truck were involved in two separate accidents only two miles apart on Interstate 35 near Waco. The first truckling accident occurred at approximately 11:30 p.m. when a pickup truck slowed in an attempt to avoid an object on the road.  A semi-truck following the pickup was able to slow down in time, but a second semi-truck could not stop in time, crashing into the first semi-truck.  This trucking accident resulted in a ruptured fuel tank requiring assistance from HazMat. The second trucking accident occurred at 4:40 a.m. when two additional tractor trailers collided only two miles away from the first accident. Fortunately no one was injured in the accident and the only problem was congested traffic.

The Texas legislature passed a bill that would make texting while driving a misdemeanor punishable by a $200 fine and up to 30 days in jail, and if texting led to a car wreck that caused serious injury or death, the offense would be elevated to a Class B misdemeanor with a maximum punishment of up to 180 days in jail and a $2000 fine.  The legislation includes email and instant messaging in the definition of “texting.”  This law follows cities, such as Austin, that previously banned texting while driving.

A legislative aide to East Texas Representative Wayne Christian was arrested by the Austin Police Department and charged with failure to stop and render aid, which is a third degree felony, following a fatal hit and run accident.
